General Terms and Conditions

1. GENERAL PROVISIONS

The General Terms and Conditions published here are an integral part of the Travel Agreement, which regulates the relationship between the travel organiser and travel.in, a travel agency, a tourism services trade (hereinafter referred to as the Organizer) and the contractor or User (hereinafter referred to as the User) and are binding on both parties. The Travel Agreement is a contract created when booking an arrangement and contains all information about the reserved package arrangement and the rights of the User and the Travel Organizer.

Individual package arrangement: A package arrangement drawn up at the User’s request and is carried out without travel companions only for these users. Group package arrangement: An advertised package arrangement is published on the travel.in website, brochures or with authorised intermediaries. It contains a fixed travel date and travel companions.

The Travel Agreement is concluded when it is signed in writing or electronically and upon payment of the total agreed price to the Organizer or partial payment of the agreed price, according to previously defined payment deadlines.

2. PRICE OF THE ARRANGEMENT

The Organizer has provided all necessary information about the arrangement in the pre-contractual information.

In addition to the pre-contractual information, the Organizer will provide the User with other standard information. The User shall pay separately for all additional fees/costs not included in the basic price. All extra services are highlighted independently in the pre-contractual information, i.e. the travel program, and they must be requested before concluding the Contract and are paid in addition to the basic price. All prices for additional services/fees listed in the program/pre-contractual information are subject to change until the Contract is drawn up. The Organizer reserves the right to change the prices that have been published and accepted by the Contract if there has been a price change that could not be influenced and is part of the package arrangement or agreed services, such as gas costs, tax amounts, various fees, and we, as the Organizer, could not influence the above.

The Organizer has the right to increase the agreed price of the arrangement/service by a maximum of 8% and must inform the User about the price increase clearly and understandably no later than 20 days before the start of the package arrangement.

3. RESERVATIONS AND PAYMENTS

The User registers for the trip by email to: travel@travel-in.hr

Upon registration, the User must make an upfront payment of 30% of the package price upon confirmation of the reservation. The remaining amount (70% of the package price) must be paid no later than 14 days before the date of departure for the trip.

The reservation will not be valid if the User does not pay the difference up to the full price by the specified deadline. It is considered that the User has cancelled the reservation, and the Organizer reserves the right to keep the amount paid for the trip until then.

The User can cancel the reservation but will be subject to the cancellation conditions specified in the offer. All reservation changes are subject to availability and may be subject to additional costs.

4. THE USER’S RIGHT TO TERMINATE THE CONTRACT

If the User cancels the travel.in the arrangement, the travel agency retains the total arrangement price:

  • 60 – 30 days before departure, 50% of the arrangement price
  • 29 – 8 days before departure, 90% of the arrangement price
  • 7 – 0 days before departure, 100% of the arrangement price

If the User who cancels the trip finds a new User of the same reservation who meets all the stipulated conditions, the travel.in agency will only charge the costs caused by the replacement.

5. OBLIGATIONS OF THE ORGANISER

The Organizer assumes the obligation to take care of the performance of the services and the selection of the service provider with the care of a good businessman and undertakes to take care of the rights and interests of the User following good customs in tourism. All the stated obligations from the travel program will be carried out in full and in the described manner, except in the case of “force majeure” or a change in circumstances. In such cases, where possible, the Travel Organizer will offer an alternative solution.

However, if the correction of the error would lead to disproportionately high costs concerning the value of the trip, the Travel Organizer is not obliged to provide such a service. The Organizer is not obliged to provide services not explicitly stated in these terms and conditions. Also, the Organizer is not liable for any printing errors.

In the event of significant changes in essential aspects of the trip (such as program, price, and accommodation) before the start of the trip, the Organizer is obliged to notify the User without delay in writing and offer him to arrange a modified arrangement of the same or higher quality. If this is not possible, the User has the right to a reduction in the price of the arrangement without terminating the Contract.

6. OBLIGATIONS OF THE USER

The User is obliged to comply with the conditions stipulated by the regulations of the Republic of Croatia, as well as the house rules in the accommodation facility and at other locations. The User is also obliged to cooperate with the representatives of the organiser and service providers at the destination.

During the trip, the User must comply with the personal safety rules that average individuals should follow. The User is responsible for any damage caused, especially if such damage results from non-compliance with the Contract and

General Terms and Conditions. The User bears such damage and is not entitled to compensation from the Organizer.
The User must also have the clothing, footwear, and equipment specified in the program.

The User is also obliged to submit all necessary information to the Organizer promptly for the organisation of the trip, including details for booking accommodation and transport tickets.

At the request of the travel organiser’s representative, the User is obliged to submit proof of full payment of the travel price before the trip/package arrangement starts. If the price has not been fully paid, the User cannot begin the trip unless the contracting parties agree otherwise.

In the event of irregularity in the implementation of the package services, the User is obliged to notify the Organizer immediately without unnecessary delay.

7. TRAVEL INSURANCE

By the Act on the Provision of Tourist Services, the Organizer must offer users a travel insurance package that includes insurance against the risk of accidents, travel illness, luggage insurance, accident insurance and trip cancellation insurance. If the User requests the insurance above, they can be arranged directly with one of the insurers, with the Organizer acting only as an intermediary.

8. COMPLAINT RESOLUTION

The User has the right to submit a complaint in writing by email to travel@travel-in.hr within 14 days after the end of the trip. The Organizer is obliged to respond to the complaint electronically within 15 days of the date of receipt of the complaint.

9. INSURANCE IN CASE OF INABILITY TO PAY OR BANKRUPTCY OF THE TRAVEL ORGANISER AND PROFESSIONAL LIABILITY INSURANCE

According to the Act on the Provision of Tourism Services, in a tourism service trade, a travel agency has a contracted insurance policy with Euroherc osiguranje d.d. for package deals in case of inability to pay or bankruptcy of the travel organiser, as well as professional liability insurance.

10. PRIVACY PROTECTION

The User is a voluntary provider of personal data. The User’s data is necessary for the implementation of the requested service and will be used for further communication (for example, a letter of intent, payment instructions, and notifications about the performance of the service). travel.in, a travel agency, reserves the right to use the User’s personal data for marketing purposes (e.g., sending notifications, promotions, newsletters). The User can unsubscribe anytime via the “Unsubscribe” link at the bottom of each email or by requesting travel@travel-in.hr. Objection to processing personal data for marketing purposes will not affect the contracting and/or implementation of the requested service.

11. INTELLECTUAL PROPERTY RIGHTS

The content published on the travel.in website is protected by copyright and may not be reproduced or used without prior permission.

12. RIGHT TO CHANGE THE TERMS OF USE

travel.In reserves the right to change these terms of use with prior notice to users via the website or email. By using the travel.in services, the User agrees to the stated terms of use.
